Brian Judd Tours Inc. – Terms & Conditions

Welcome to Brian Judd Tours Inc. These Terms & Conditions are designed to clearly explain how our tours and cruises operate and what you can expect when traveling with us.

1. Agreement to Terms

By booking, participating in, or traveling on any tour or cruise operated by Brian Judd Tours Inc., you agree to these Terms & Conditions.


2. Acceptance of Terms Through Booking, Payment & Travel

By placing a deposit, making final payment, or traveling:

  • You confirm you had access to these Terms

  • You accept them fully

  • This applies to deposit, final payment, and travel participation

This agreement is binding upon you and your family, heirs, and estate, to the fullest extent permitted by law.


3. Nature of Group Travel

  • Travel is a group experience

  • Schedules are set for the group

  • Tour guides manage the group as a whole

Missed activities due to lateness = no refunds


4. Physical Requirements & Pace of Travel

Travel may include:

  • Walking, standing, stairs, uneven terrain

  • Conditions that differ from U.S. standards

You agree:

  • You can keep pace with the group

  • The group cannot slow for individuals

If you cannot keep pace:

  • You are responsible for your own transportation costs to rejoin the group

We encourage travelers to choose tours that match their comfort, pace, and ability.
You may contact our office for details before booking.


5. Seating & Motor Coach Policies

  • Seat rotation may be required

  • Seats cannot be reserved

  • Front seats are not guaranteed


6. Third-Party Providers

We use independent providers (airlines, hotels, cruise lines, etc.).

We are not responsible for:

  • Their actions

  • Service issues

  • Accessibility limitations


7. Accessibility & ADA

We make reasonable efforts to accommodate, but:

👉 Accessibility cannot be guaranteed

Group travel may not meet all individual needs.


8. International Travel

Outside the U.S.:

  • ADA does not apply

  • Conditions vary


9. Health & Responsibility

Travelers must:

  • Be physically able

  • Manage their own medical needs

Staff do not provide medical care.


10. Safety & Conduct

We may remove a traveler for safety reasons.

  • No refunds

  • Traveler pays all costs


11. Participation Limitations

If you cannot participate in an activity:

👉 No refunds or credits


12. Itinerary Changes

We may adjust itineraries due to conditions beyond our control.


13. Baggage

We are not responsible for lost or damaged items.


14. Travel Insurance (Strongly Recommended)

We strongly recommend travel insurance.

We are not responsible for:

  • Coverage decisions

  • Denied claims


15. Assumption of Risk

Travel involves risks, including:

  • Injury

  • Illness

  • Death

  • Environmental and international risks

You accept these risks.


16. Limitation of Liability

We are not liable for:

  • Injury or death

  • Loss or damage

  • Delays


17. Release of Claims

You agree not to bring claims against:

Brian Judd Tours Inc., its staff, or representatives.

Applies to you and your family, heirs, and estate.


18. Deposits & Payments

Deposits are used immediately to secure:

  • Flights

  • Hotels

  • Transportation

  • Activities

These may be non-refundable

Deposit confirmations will outline penalties.


19. Photography Release

Photos/videos may be used for marketing.


20. Force Majeure

We are not responsible for events beyond our control.


21. Governing Law

State of Utah


22. Arbitration & Venue

All disputes:

  • Must be handled in Salt Lake County, Utah

  • Will be resolved through binding arbitration


23. Class Action Waiver

All claims must be brought individually.


24. Severability

If one part is invalid, the rest still applies.
